Ice Cream Store Owner in Yorktown Charged with Child Pornography

A Yorktown resident who also owns a business in the community was arraigned today on two felony child-pornography charges.

Richard Scarchilli, 69, of 351 London Road, Yorktown Heights was charged with one count of promoting a sexual performance by a child, a class “D” Felony, and  one count of possessing an obscene sexual performance by a child, a class “E” Felony.

Scarchilli, the owner of Richie’s Ice Cream Store and Bakery on Downing Drive in Yorktown Heights, is accused of making available a digital video, of three 8 year old girls in a sexual performance, through an internet site that caters to pedophilia on February 8, the Westchester District Attorney’s Office stated in a release.

Investigators from the DA’s Office recovered a computer from the defendant’s home on April 29. A forensic analysis recovered digital video of a child under 16 engaged in a sexual act, according to the release.

Scarchilli surrendered and was arraigned in Cortlandt Town Court. He was released on his own recognizance and is scheduled to appear at the County Court in White Plains on September 27 where Assistant District Attorney Michael Delohery, chief of the High Technology Crimes Bureau, will prosecute the case.

Scarchilli, if found guilty, faces a maximum of seven years in prison.
