Though a state Supreme Court judge did not rule in his favor, Anthony Futia said is not ready to concede that two Democratic North Castle Town Board candidates should stay on the ballot.

State Supreme Court Judge Robert DiBella recently ruled that Democrats Jose Berra and Barry, who are running for the town board this fall, could remain on the ballot despite Futia’s challenge.

. Futia had argued that he and the rest of the town Democratic Committee, which voted unanimously to endorse Berra and Reiter, did not know at the time that the two candidates were both not affiliated with any political party.

Futia said on Aug. 9 that he was continuing to explore his options regarding the ballot issue involving the Democrats. “I’m getting the decision and I’m waiting to review the results” before announcing his next step in his ballot challenge, Futia said.
